(ADVERTISERS)
STANDARD TERMS AND
CONDITIONS OF SUPPLY
This
agreement contains the terms and conditions on which the places2eat-sleep-drink.com
Advertisers are
to be bound.
Content of Advertisements:
Trimast Systems Limited trading as The
places2eat-sleep-drink.com online directory from
herein referred to as "The Company",
"us " or "we" accepts advertisements in good faith and
expects that advertisers will provide an accurate description of their
establishment.
All advertisements should comply with relevant UK legislation
including the Trade Descriptions Act 1968 (which covers false descriptions) and
the Consumer Protection Act 1987 (which covers misleading prices). The
advertiser agrees to indemnify us against all claims and costs
arising out of any misleading information in the advertisement.
We will take every care to reproduce faithfully the text, prices,
contact details and photographs provided to us by advertisers. We will not
however be held liable for any loss arising out of any error or omission on our
part.
We reserve the right to determine the design
and layout of advertisements, and (at our discretion) make alterations to
submitted text or photographs, should we consider any to be necessary. We will not be held liable for any loss arising out of such
alterations.
Materials and
Photographs:
We will take the utmost care of all materials
and photographs provided for the preparation of advertisements, but cannot be
held liable for any loss or damage however caused. All photographs should be
sent to us either electronically via e-mail
to listings@places2eat-sleep-drink.com or
posted to us in a photographic or postcard
print. We regret that we will be unable
to return any photograph or post card sent
to us unless a pre paid self addressed envelope
is submitted with the photo.
Copyright:
It
is the responsibility of the advertiser to ensure they have the right to
reproduce any photographs or digital images which they supply to us. The
advertiser agrees to indemnify us against all claims and costs
arising out of any infringement of copyright for such photographs or
images.
All digital images produced by us from
photographs supplied by advertisers and shown on the places2eat-sleep-drink.com
online directory website found at http://www.places2eat-sleep-drink.com
or any of our partner sites, shall then
become our property and shall not be reproduced without our permission.
Liability:
We cannot be held liable for any loss or damages
howsoever incurred, including consequential losses such as lost income, in
connection with advertising on the places2eat-sleep-drink.com online directory website.
Link to Establishment / Company Website:
We will (in accordance with our products
and services) include one
link per advertisement to an establishments / companies website. This link will be placed in
the establishment details page and at a
location determined by us. The Establishment
or Company
website must relate only to the establishment or company advertised on our web site. We reserve
the right to refuse such links, or remove them without notice.
Refusal,
Termination or Withdrawal of Advertising:
We reserve the absolute right to refuse to
accept any advertisement submitted. If the advertisement has been paid for
on-line a full refund will be made, if a cheque has been received by post
this will be returned, or if an establishment has signed up with a Franchised
Agent acting on our behalf, they shall receive
a full refund. Any materials submitted by post will be returned. Under
no circumstances will any compensation be payable by Trimast Systems Limited for
any loss howsoever incurred, including loss of income, the time/cost involved in
submitting the advertisement etc.
If we receive a
complaint about a property, we reserve the right to remove that property from
our web site without notice, if in our opinion the complaint is reasonably
substantiated. Such complaints could relate to the accuracy of an advertisement,
the condition or maintenance of the establishment, unacceptable booking conditions or
procedures, lack of adequate response to complaints etc. In all cases our
decision will be final.
A
refund will not be paid and under no circumstances will any compensation be
payable by us for any loss howsoever incurred, including
loss of income, re-advertising costs etc.
The advertiser may choose to
withdraw their advertisement from the The places2eat-sleep-drink.com online
directory website at any
time - please notify us in writing (letter or e-mail). They may also request
that their advertisement is reinstated at any time during the period of
advertising purchased. Please note that the period of advertising will not be
extended to allow for the time when the advertisement was not showing on the web
site.
Member Submitted Reviews & Ratings:
Each establishment listed within The
places2eat-sleep-drink.com online directory
is available for written reviews and ratings
from register members of our website.
We will endeavour to ensure that any
review submitted represents a true and accurate
impression based upon the opinion of the
member responsible for submitting the review
of the establishment in question.
The places2eat-sleep-drink.com online
directory is an indepentently run website
and we openly encourage registered members
to register their opinions of establishments
listed within our directory. We openly accept
both good and bad reviews as equals and
under no circumstances shall we remove any
negative reviews unless the review can be
proved as untrue. If we receive a negative
review of your establishment we shall do
our best to contact you for the purpose
of providing you with advanced warning of
a negative review been published and the
contents of said review. You shall additionally
be given the opportunity to respond to any
negative review should you wish to do so.
We shall not be held liable for any loss
of business which occurs as a direct result
of any review submitted to our directory.
Furthermore should the owner of the establishment which
is the subject of a review wish to remove
their establishment from the directory due
to the contents of the review no refund
either in full or part shall be given.
Level of Service:
We will make every effort to provide advertisers
with a first class service. We will endeavour to approve new establishment listings, and
approve changes to existing establishment listings, promptly - normally within 24 hours.
We will endeavour as far as practical to ensure
that the website is available on the internet at all times. However some breaks
in service are inevitable and often beyond our control, we are therefore unable
to guarantee 100% availability.
